On "0% US Federal Tax"
The 0% US federal income tax outcome described in this article applies only when your Wyoming LLC income is not Effectively Connected Income (ECI) with a US trade or business, and is not US-source Fixed, Determinable, Annual, or Periodical (FDAP) income subject to withholding. The distinction is highly fact-specific and depends on where services are physically performed, where inventory is located, whether you have a US dependent agent, whether you use US-based contractors, and other factors under IRC sections 864, 871, 881, and 882. A single misclassified activity can convert your entire year into ECI. Always confirm your specific facts with a US-licensed CPA or tax attorney before relying on a 0% position.
On Beneficial Ownership Reporting (BOI / CTA)
Under the US Corporate Transparency Act, most LLCs โ including Wyoming LLCs owned by non-US persons โ may be required to file a Beneficial Ownership Information (BOI) report with FinCEN. This filing is separate from Wyoming public state records and requires disclosure of the personal identifying information of every beneficial owner (name, date of birth, address, ID document) directly to the US Treasury.
