EIN, SSN, and ITIN: What Every Foreign LLC Owner Actually Needs to Know
By Wyoming Experts | Tax & Compliance Guide |
If you have ever tried to research U.S. tax ID numbers as a non-American entrepreneur, you have almost certainly walked away more confused than when you started. Three acronyms - EIN, SSN, and ITIN - show up constantly in articles about forming a U.S. LLC, opening a bank account, and filing taxes. But most explanations are written for U.S. citizens, which means the part that actually matters to you gets buried or glossed over.
This guide is written specifically for international founders - people living outside the United States who want to operate a Wyoming LLC the right way. After forming companies for clients in over 70 countries, we have answered this question thousands of times. Here is the clear version.
Start Here: What Is a TIN?
TIN stands for Taxpayer Identification Number. It is an umbrella term the IRS uses to refer to any nine-digit number it uses to track tax obligations. An SSN, an EIN, and an ITIN are all types of TINs - they just apply to different situations and different people.
Think of it this way: the IRS needs a number to attach to every tax filing, whether it comes from a person or a business. The TIN system is how it organizes everything. Knowing which TIN applies to your situation is what this guide is about.
Social Security Number (SSN): Not Your Problem
An SSN is a nine-digit number issued by the Social Security Administration - not the IRS - to U.S. citizens and certain authorized residents. It is used for employment, benefits, and personal tax filings. The format looks like this: XXX-XX-XXXX.
If you are a non-U.S. resident forming a Wyoming LLC from abroad, you almost certainly do not have an SSN, and you do not need one to run your company. The SSN belongs to individuals with legal U.S. residency or work authorization.
Foreign founders do not need an SSN to form a U.S. LLC, to get an EIN for that LLC, or to operate a U.S. business. The SSN is simply not part of your process.
The only reason an SSN becomes relevant is if you later move to the United States, obtain a visa that grants work authorization, or become a resident. Until then, it does not apply to you.
Employer Identification Number (EIN): The One You Actually Need
The EIN is the tax ID number for your business entity. Just as individuals have a Social Security Number to identify themselves to the IRS, your Wyoming LLC has an EIN. The format is XX-XXXXXXX - nine digits, but grouped differently from an SSN.
Despite the name, you do not need to have employees to get an EIN. The name is a historical artifact. What the EIN actually does is identify your LLC in every interaction with the U.S. tax system, the banking system, and payment platforms.
Why you need an EIN
Your EIN is required for virtually every meaningful step after forming your Wyoming LLC:
Opening a U.S. business bank account - virtually every U.S. bank and fintech requires it
Setting up U.S. payment processing accounts
Filing your annual tax returns - including Form 5472 and the pro forma 1120 that foreign-owned single-member LLCs must submit
Signing contracts with U.S. companies and clients
Applying for business credit or financing in the U.S.
Hiring U.S.-based contractors or employees
Without an EIN, your LLC exists on paper but cannot actually function as a business.
Can foreign founders get an EIN without an SSN?
Yes - and this is probably the most common misconception we encounter. Many entrepreneurs assume they need an SSN or ITIN before they can apply for an EIN. This is not true.
The IRS issues EINs to foreign founders every day. The process is slightly different from the path available to U.S. residents, but it is entirely straightforward. Here is how it works:
You cannot use the IRS online EIN application portal if you lack an SSN or ITIN - that portal is restricted to applicants with existing U.S. tax IDs
Instead, you apply by completing Form SS-4 and submitting it by fax or mail, or by calling the IRS international line at +1 267-941-1099
On line 7b of Form SS-4, where the form asks for an SSN or ITIN, you write "Foreign" - this is explicitly permitted by IRS instructions
The responsible party listed on the form must be an individual (the actual owner), not a company or a nominee
Processing time via fax is typically 4 to 6 weeks. Via phone, you can sometimes get the EIN assigned during the call itself, though this varies.
Important: Your LLC must already exist - that is, the state must have approved your Articles of Organization - before you submit your EIN application. The IRS matches the entity name on your application to state records. Applying too early creates avoidable delays.
Individual Taxpayer Identification Number (ITIN): When You Need One
An ITIN is a tax ID number for individuals who need to interact with the U.S. tax system but are not eligible for an SSN. The format mirrors an SSN (XXX-XX-XXXX) and always begins with the digit 9.
The key word here is individual. An ITIN identifies you as a person, not your business. It serves a completely different purpose than an EIN, and the two are not interchangeable.
Do you need an ITIN as a foreign LLC owner?
This is where most guides get fuzzy. The honest answer is: it depends on your tax situation.
If you own a single-member Wyoming LLC that is taxed as a disregarded entity - the default for foreign-owned single-member LLCs - your annual filing obligation is Form 5472 attached to a pro forma Form 1120. This filing uses your EIN, not an ITIN. You do not need an ITIN for this.
However, an ITIN becomes necessary in specific situations:
You need to file a U.S. personal income tax return (Form 1040-NR), for instance if your LLC generates income that is considered effectively connected with a U.S. trade or business
You want to claim treaty benefits under a tax treaty between the U.S. and your home country
Your LLC is a multi-member structure and you are required to file a Form 1065 partnership return that requires individual identification
Some banks and financial institutions ask for an ITIN when opening accounts, though many platforms that serve international founders accept an EIN alone
If none of these situations apply to you - which is the case for many straightforward e-commerce or service businesses owned by a single foreign founder - you may never need an ITIN at all.
How to apply for an ITIN
ITIN applications go through Form W-7, submitted to the IRS with supporting documents proving your foreign status. The most common supporting document is a passport - either the original or a certified copy from a Certifying Acceptance Agent (CAA).
Working with a CAA is strongly recommended. They can verify your identity locally so you do not have to mail your original passport to the IRS, which carries obvious risks and can take months. Processing time for ITIN applications is typically 7 to 11 weeks, and longer during peak filing season.
Note that you cannot apply for an ITIN speculatively, before you have a reason to file. The IRS requires that your ITIN application be submitted alongside a tax return or a valid exception.
Questions We Get All the Time
Can I use my EIN instead of an SSN when filling out forms?
For business purposes, yes. If a U.S. company asks you to complete a Form W-9 for payment reporting, you can list your LLC and its EIN rather than providing a personal SSN. This is the normal approach for foreign owners operating through an LLC.
Do I need an ITIN to open a U.S. bank account?
Not necessarily. Many banks and fintech platforms that work with international founders accept an EIN and a valid foreign passport. Traditional banks sometimes require more documentation, but they are generally less accessible to non-residents regardless. An ITIN can smooth the process with some institutions, but it is rarely the deciding factor.
What happens if I get an ITIN and then become eligible for an SSN?
If you later obtain an SSN - for example, after moving to the U.S. on a work visa - the IRS deactivates your ITIN. You cannot hold both simultaneously. You would inform the IRS of your new SSN and it becomes your identifying number going forward.
Is the EIN permanent?
Yes. Once assigned, an EIN does not expire and does not need to be renewed. It is permanently associated with your LLC. If your LLC is dissolved and you later form a new one, the new entity gets its own EIN - the old one cannot be reused or transferred.
How long does it take to get an EIN from outside the U.S.?
Via fax: typically 4 to 6 weeks. Via the IRS international phone line: sometimes same-day, though availability varies. Via mail: 4 to 8 weeks. We handle EIN applications as part of our formation service, so our clients generally receive their EIN within the standard fax window without having to navigate IRS phone queues themselves.
The Right Order of Operations
One of the most common mistakes we see from international founders is trying to do things in the wrong sequence.
Here is the correct order:
1. Form your Wyoming LLC. The state must approve your entity before you can apply for an EIN. Get your Articles of Organization filed and confirmed first.
2. Apply for your EIN. Once your LLC exists in the state system, file Form SS-4 by fax or phone. Use your approved LLC name exactly as it appears on your formation documents.
3. Open your business bank account. With your EIN in hand, you can approach banks and fintech institutions that serve international founders.
4. Set up your payment infrastructure. Payment processors and platforms require your EIN for onboarding. Do this after your bank account is in place.
5. Address your ITIN separately, if needed. If your tax situation requires personal U.S. filing, apply for your ITIN at tax time with Form W-7 and your first return. Do not delay everything else while waiting for an ITIN you may not need.
Getting these steps in order saves weeks of frustration. We have seen founders stall their entire setup for months because they were waiting for an ITIN they never actually needed.
One More Thing Worth Knowing
The U.S. tax system was not designed with international entrepreneurs in mind. The forms, the acronyms, the different application channels - all of it grew organically over decades, primarily for U.S. residents.
What looks like a confusing maze from the outside is actually a fairly logical system once you know which parts apply to you.
For most foreign founders with a Wyoming LLC: you need an EIN, you probably do not need an ITIN right away, and you definitely do not need an SSN. Start there, and get the rest figured out as your business actually generates the situations that require it.
At Wyoming Experts, we handle EIN applications as a standard part of every LLC formation. If you are not sure what your tax situation requires, our team can walk you through it - no forms to decode on your own.

FAQ
Do I need an SSN to form a Wyoming LLC?
No. Non-U.S. residents do not need a Social Security Number to form a Wyoming LLC or to obtain an EIN for it. The LLC formation process and the EIN application are both available to foreign nationals.
What is the difference between an EIN and a TIN?
TIN is the umbrella term for all U.S. taxpayer identification numbers, including EINs, SSNs, and ITINs. An EIN is specifically the tax ID number for a business entity. Every EIN is a TIN, but not every TIN is an EIN.
Can I apply for an EIN online without an SSN?
No. The IRS online EIN application portal requires an SSN or ITIN. Foreign founders without either must apply by fax, mail, or phone through the IRS international line (+1 267-941-1099).
Does a Wyoming LLC need an ITIN?
The LLC itself does not need an ITIN - it needs an EIN. The owner may need an ITIN for personal U.S. tax filings in certain situations, but this is separate from the entity's own tax ID requirements.
How long does it take to get an EIN as a non-resident?
Via fax: 4 to 6 weeks. Via the IRS international phone line: potentially same-day. Via mail: 4 to 8 weeks. Submitting a clean, complete Form SS-4 is the single most important factor in avoiding delays.
